Terms of Service
Last updated October 29, 2026
Acceptance of these Terms
These Terms of Service form an agreement between you and Mitsu Art ("we", "us", "our") for the use of mitsuart.net (the "Website"), together with the documents they refer to: our Privacy policy, Shipping policy and Refund & return policy.
By using the Website or placing an order, you accept these Terms. If you do not accept them, do not use the Website. You must be of the age of majority where you live to place an order, or have the consent of a parent or guardian.
Changes to these Terms and to the Website
We may update these Terms. A change applies from the moment it is posted here, with the date above; it does not change an order already placed. We may also change, suspend or withdraw any part of the Website at any time, and we are not liable if the Website is unavailable for a while.
Orders and pre-orders
Purchases are governed by these Terms, our Shipping policy and our Refund & return policy. Checkout and payment are operated by Shopify and also follow the terms shown at checkout.
- Prices are shown in the currency of the Website and do not include shipping, duties or local taxes unless stated at checkout.
- Your order is a request to buy. We confirm it by email. We may refuse or cancel an order, for example after an obvious price error, a suspected fraud, or a product we can no longer supply; you are then refunded in full.
- Pre-orders are paid when you order. The shipping window shown on the product page is an estimate. Cancellation and refund rules for pre-orders are in our Refund & return policy.
- Creator codes (for example a code shared by an artist we work with) apply to the products of their drop only, one code per order, and cannot be combined with another discount.
- Limited editions are limited to the quantity stated. We may limit the number of items per customer.
Security of the Website
You must not try to get around or break the security of the Website, including: (a) reaching content or data not intended for you; (b) breaking or testing our security or authentication without permission; (c) disrupting the service for other visitors, hosts or networks; (d) using robots, scrapers or other automated means to access or copy the Website; (e) introducing viruses or other harmful material; (f) attacking the Website by denial of service, flooding or similar means; or (g) otherwise interfering with how the Website works.
Intellectual property
The Website and everything on it (artwork, characters, text, images, video, audio, design and code) belong to Mitsu Art, its licensors or other owners, and are protected by copyright, trademark and other laws. Mitsu, Mitsu Art, Eyri Project and our logos are our trademarks; you may not use them without our written permission. Other names, characters and logos on the Website belong to their respective owners, including the artists and creators we collaborate with.
You may use the Website for your personal, non-commercial use. You may not copy, reproduce, redistribute, sell, print for sale, modify, or create derivative works from any artwork on the Website, or use it to train or feed artificial-intelligence models, without our written permission. Your browser may cache pages, and you may share links to the Website on social media as those platforms allow.
Buying a print or a product gives you the physical item, not the copyright in the artwork.
No reliance
The content of the Website is for general information. We try to keep it accurate and up to date, but we do not promise that it always is. Product photos, renders and 3D previews show the design; the finished item can differ slightly (see "Small differences" in our Refund & return policy).
Privacy
Our Privacy policy explains what personal information we collect and how we use it. By using the Website, you accept it.
Third-party websites
The Website links to other sites (social networks, Shopify's checkout, our partners). We do not control them and are not responsible for their content or their practices; their own terms apply. You may link to our Website, as long as you do so fairly and do not suggest that we endorse you when we do not.
Where we sell
We sell from Québec, Canada, to the countries offered at checkout. You are responsible for following the laws of the place where you use the Website, and for any import duties or taxes on your order, as explained in our Shipping policy.
Disclaimer of warranties
YOUR USE OF THE WEBSITE IS AT YOUR OWN RISK. THE WEBSITE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT ANY WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE WEBSITE WILL BE ERROR-FREE, UNINTERRUPTED, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. THIS DOES NOT AFFECT THE WARRANTIES THAT THE LAW GIVES YOU AS A CONSUMER ON THE PRODUCTS YOU BUY, WHICH CANNOT BE EXCLUDED.
Limitation of liability
TO THE EXTENT ALLOWED BY LAW, MITSU ART AND ITS PARTNERS, EMPLOYEES, AGENTS, SUPPLIERS AND LICENSORS ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA OR GOODWILL, ARISING FROM YOUR USE OF, OR INABILITY TO USE, THE WEBSITE. FOR A PURCHASE, OUR TOTAL LIABILITY IS LIMITED TO THE AMOUNT YOU PAID FOR THAT ORDER. NOTHING IN THESE TERMS LIMITS A LIABILITY THAT THE LAW DOES NOT ALLOW US TO LIMIT.
Indemnification
To the extent allowed by law, you agree to defend and indemnify Mitsu Art, its partners, employees, agents, suppliers and licensors against any claim, loss, cost or expense (including reasonable legal fees) arising from your breach of these Terms or your misuse of the Website.
Governing law
These Terms are governed by the laws of the Province of Québec and the federal laws of Canada that apply there. This does not take away the protection that the mandatory consumer laws of your country give you.
Waiver
If we do not enforce a right under these Terms, or enforce it late, we have not given that right up.
Severability
If a part of these Terms is invalid or unenforceable somewhere, the rest of these Terms still applies, and that part still applies where it is valid.
Entire agreement
These Terms and the policies they refer to are the whole agreement between you and Mitsu Art about the Website, and replace any earlier agreement on the same subject.
